This page defines the terms and conditions of using the website, Deals.mu and the services we offer.

By accessing, browsing and using Deals.mu and/or by making a purchase through us, you are acknowledging and agreeing having read, understood and agreed to the following Terms & Conditions.

Our aim is to be as professional, efficient and courteous as possible with our users, customers and business partners. As such, it is important to know the terms and conditions and who we are. This is a legal document which is the agreement between Deals.mu (whom we refer to as “Deals.mu”, "we", "our" and "us") and the User and/or Customer (referred to as "you", "your", "he", "she", "the User", or "the Customer" in this document) who is the person using the site, registered to the site, and/or purchasing any services, making reservations including all bookings made for one, two or more people; these terms are applicable for all the people in your group, referring to any person who will accompany you or is to attend the booking; for the avoidance of doubt any individual you make a booking on behalf of.

It is taken that you are the lead contact for your group and that therefore all correspondence and conversations in respect of arrangements for yourself and all members of your group will take place between you and us. Thus you are agreeing to the Terms and Conditions that appear below, all of which are called the “Agreement”. We reserve the right to amend these terms and conditions at any time. No alteration to these conditions shall be effective unless expressly agreed to in writing by the director of Deals.mu.
When these Terms use the term "Service Provider," we mean local service providers, suppliers and our partners using the Services of Deals.mu to create, offer and sell their products/services.

1.0 The Deals.mu Marketplace

1.1 Deals.mu acts as a marketplace for products and services offered by Service Providers to local residents of Mauritius (National ID card and Resident Permit holders). This means that we are an intermediary between customers and service providers and are not responsible for the terms and conditions set by the Service Provider.

1.2 Please note that while some of the products/services listed on the Site may appeal to children, the Site is not targeted at users under the age of 18, and they are not permitted to use the Site. We strongly encourage all parents and guardians to monitor the Internet use by their children. If you use the Site, you affirm you are at least 18 years old.

2.0 Accounts

2.1 In order to use some parts of the Website, you may need to create an account. To create an account on Deals.mu, you must be at least 18 years old. An account offers you easy access to purchasing and booking an offer (you will not have to re-enter your information each time you make a reservation), viewing your order history as well as automatically signing you up for the Deals.mu Loyalty program. You must provide full and accurate information when you create your account with us. You are solely responsible for the activity that occurs on your account, and so we suggest that you keep your account password secure. You must notify us immediately if you are aware of any unauthorised use of your account.

2.2 Registration and your account. To register for an account, you must provide us with your name, email address, password and possibly other personal information. Or you can create an account on Deals.mu using your social media logins from Facebook, Instagram or Google. All accounts must be registered with a valid personal email address that you access regularly. All accounts that have been registered with someone else's email address or with a temporary email address may be closed without notice. We may ask users to revalidate their accounts if we believe they have been using a valid email address. You must ensure that your password is kept confidential and must inform us immediately if you have reason to believe that your password is known to an unauthorized third party or if there is any unauthorized use of your e-mail address and your account. You agree that we are not responsible for the transactions and usage that occur under your account and that you are solely responsible if you do not manage the confidentiality of your password.If you have any questions or need assistance in any way, please contact our customer service at info@deals.mu

3.0 Products and Services

3.1 Buyers may search Deals.mu for a specific product, service or other search category. Each offer listing contains the package name, details, conditions and price. Deals.mu does not guarantee the accuracy of any information provided about the offer.

3.2 The products and services offered on the Deals.mu website are valid within the limits of availability and they are provided to the customer through Service Provider/s and third parties.

3.3 The photos, illustrations and other promotional material used for the description of the product/service are for the purpose of exemplifying products/services of the same type. We cannot guarantee that all photos advertised and used on our website illustrate the exact attraction as offered by the service provider. The only purpose of these photos is to give the customers a better idea of the offer. The descriptions and illustrations on any of our content and our website are given as approximate representations only, but in good faith.

3.4 No compensation of any kind or responsibility can be taken due to circumstances beyond our or our service provider's control. The products/services on offer are based on normal road, weather and operational conditions and this may change if conditions are unfavorable or due to unforeseen operational problems. A circumstance beyond our or our supplier’s control is unpredictable, even after taking all due care, and includes but is not limited to personal loss, injury, accidents, damage of any description to person or personal property, war, terrorist activity, civil unrest, industrial disputes, acts of god, natural or nuclear disaster, high level of water, technical or maintenance problems and bad weather situations or forecasts. Deals.mu aims to be precise on the details appearing on its website but we make no commitment as to the accuracy and/or reliability that you will obtain from using our website or material. Deals.mu also reserves the right to cancel scheduled tours, operations, attractions and activities at any time in the event of hazardous weather conditions or unforeseen operational problems. We reserve the right to refuse admission to anyone at its sole discretion.

4.0 Reservation and Booking

4.1 To book and redeem a deal or offer bought on our website, you must be a Mauritian Citizen or Resident (resident permit holder) and have identification to prove it. This ID must be shown to the service provider, along with your booking confirmation voucher at the time of redeeming any deal or offer purchased. Should a Non-Mauritian citizen or resident book a deal, or if the Mauritian Citizen or Resident forgets to present identification when redeeming the offer, the supplier reserves the right to not honor the package booked and no refund will be granted.

4.2 Booking on behalf of somebody who is not a Mauritian Citizen or Resident of Mauritius is not allowed on Deals.mu. This includes bookings for family, friends and foreigners including group bookings with Mauritian and non-Mauritian members- such bookings will not be valid and even Mauritian members of the group will not be allowed to redeem the package.

4.3 The user, by using the Deals.mu site or processing a booking via the site hereby confirms that they read and accept i) the terms and conditions of Deals.mu and ii) the terms and conditions of the offer by the service provider. Once a booking has been made, the user and the service provider will be bound by these terms and conditions and both parties will receive a booking confirmation email.

4.4 Online bookings and purchases. Once you identify the offer you would like to purchase, and confirm your intent to purchase it, you will be directed through the checkout process where you will be required to enter your name and address, and provide payment information. You can do this by either creating a Deals.mu account or logging in with your existing Deals.mu account. You will also be able to review the order details and total order price.

4.5 Once you have confirmed your order and payment, you will receive an Order Confirmation email and once payment has been processed, a Payment Confirmation along with the Booking Confirmation will be sent by email. It is important that you provide the correct email address. If you do not receive any email (Order, Payment or Booking Confirmation) within the next 15 minutes of placing the Order, you should contact us.

4.6 A Booking Confirmation email is a proof of a valid booking and will contain relevant information about the booking and particulars of the product/service concerned. Please read and carefully check all the information contained in your Booking Confirmation email to ensure that it conforms to your reservation made. If there are any changes to the details, we request that you inform us immediately by email, phone or by contacting our Customer Service department. An Order Confirmation or Payment Confirmation email does not mean that the booking is confirmed- it’s part of the booking process.

4.7 You will be required to print and produce your Booking Confirmation Voucher when you redeem the package, as well as a valid Mauritian ID or a Mauritian Residency Permit. The identification of the person whose name is on the booking must be provided when redeeming the package.

4.8 Other booking and purchasing methods. Offers may also be purchased through phone bookings by calling 269 1500 or by visiting the Deals.mu head office.

4.9 By placing an order, you authorize Deals.mu to charge your method of payment for the total order amount. Upon order confirmation, your method of payment will be charged and you will receive your booking confirmation voucher by email.

4.10 By making a booking with us (whether directly through Deals.mu's website or by email or by phone or by visiting the head office), you and all members of your group acknowledge to have understood and accepted our Terms and Conditions and that in the case of group bookings (2 persons & more), the person making the reservation is responsible for making all members of his or her group aware of these conditions.

4.11 Any customers with special needs should inform the Deals.mu customer service team of any special requirements at the time of booking. We will do our best to cater for the needs of the special needs participant.

5.0 Open Vouchers

5.1 Customers have the option to order an open voucher for a specific package, such as Spa, Activities or any other applicable service. The open voucher can only be used for the specific product for which it has been booked as detailed on the order confirmation and on the voucher itself.

5.2 Please note that the Open Voucher is only valid for use for the relevant product or service for which it was purchased and is valid for the period specified on the package from the day of its purchase; meaning, the package voucher must be redeemed during the package validity period (90 days or until the package expires- depending on the package type). Please note that all reservations are subject to availability and if seasonal rates affect the package, the customer may need to pay the difference.

5.3 In case the customer fails to use the open voucher during the validity period, the open voucher will no longer be of any use or value and it will be void. In case of a void open voucher, the customer will not be entitled to receive any refund or compensation against the payment made to purchase the voucher.
In case the customer still wishes to use the open voucher, but will not be able to within the valid 3-month period, they should inform Deals.mu before the expiration date of the voucher and the voucher date may be extended for a 20% supplement (applicable on the amount paid). This is why we strongly encourage our customers not to wait for the last moment in order to use the open voucher.

5.4 It is in the customer's responsibility to reserve the product or service in advance while providing Deals.mu at least 5 days notice in order to confirm the booking. In case you request to reserve a product or service for a specific date less than 5 days prior to the date on which you would like to redeem your voucher, we cannot guarantee that your reservation will be confirmed. Accordingly, for late reservations requests made during the last 5 days of the open voucher validity period, we cannot guarantee that these reservations will be confirmed or done successfully. In case Deals.mu will not be able to accommodate late reservation requests, the customer will not be entitled to any refund or compensation against the payment made to purchase this voucher. We thus strongly encourage our customers not to wait for the last moment in order to use the open voucher.

6.0 Gift Voucher

6.1 Customers have the option to order a gift voucher also referred to as a gift card, for a specific value which can be used on any of the offers and packages on Deals.mu.

6.2 The gift voucher is valid for one year from the date of purchase. Once a gift voucher has exceeded its validity period, it is no longer valid and the gift voucher will be void. We strongly encourage recipients of the gift voucher to not to wait for the last moment in order to use the voucher.

6.3 To Purchase a gift voucher. Deals.mu has a dedicated section for purchasing gift vouchers, where you can customise the gift card appearance, add the recipient's name and email address, choose the desired value of the gift card and delivery date. The gift voucher will be added to your cart and the usual check out procedure will follow (see clause 4.4).

6.4 To redeem a gift voucher. You can redeem a gift voucher either by entering the gift voucher code during the order process on the cart page, or, by clicking on the “Apply to Cart” button on your account page, which will then apply the gift voucher amount automatically on your purchase amount.

6.5 Gift vouchers are non-refundable and non-transferrable.

7.0 Availability and Price

7.1 It is advised to place your order a minimum of 5 days before your preferred date so that we can process your request and confirm your booking for the desired date(s). All reservations are subjected to availability.

7.2 All prices are listed in Mauritian rupees and are inclusive of VAT at the applicable rate at the time of your order. Prices and availability are subject to change.

7.3 Please refer to the package description for the price of each specific product/service (Attraction, Activity, Tour, Excursion, Hotels etc). Unless detailed otherwise in the specification of the product, these prices do not include transportation, food, beverages, guide, tips/gratuities to tour directors, drivers, and local guides, and do not include any other service which is not detailed in the specification of the package. All purchases are final, and no changes to the package conditions, highlights or description are allowed. These will be clearly specified at the time of booking and on the confirmation email. Prices are based on the local tariffs offered by the Service Providers.

7.4 As we act only as an agent for our suppliers / Service Providers, Deals.mu and our suppliers reserve the right to change, amend or correct prices shown on our site at any time before or after you have booked. After you have booked, if the price of your booking is affected, we will inform you as soon as possible and offer you to pay the price difference, or otherwise, cancel the booking and receive a refund.

7.5 It may occur that a confirmed booking will no longer be available and/or cancelled by the service provider before the date of the package. In such cases, Deals.mu will contact you about the cancellation, and you will be entitled to a full refund - the amount paid for the package only, there will be no additional compensation.

8.0 Payment

8.1 By placing your order, you authorise Deals.mu to charge your method of payment for the total amount. The data recorded by Deals.mu will constitute proof of all transactions by Deals.mu and its customers. When you submit this information after the order process, you accept all of these terms and conditions.

8.2 We accept payment by Credit card (Visa, Mastercard, American Express) Bank Transfer, Direct MCB Bank Deposit and MCB Juice for all online bookings. For bookings made at the Deals.mu Head Office, payments by Debit Card, Credit Card and Cash are accepted.

8.3 Deals.mu uses the MIGS MasterCard secure online payment system operated by the Mauritius Commercial Bank (MCB). MasterCard guarantees a high-level of protection when providing your credit card number. Information regarding your payment is not accessible to third parties and is not communicated to us; it is only kept on the secure database of MasterCard.

8.4 For web orders, should the customer choose the option of paying via credit card, a full payment by credit card is required to make a reservation. Payment must be made with a valid credit card. Credit cards which are accepted are VISA, MasterCard and American Express. The order confirmed by the client will be considered valid only when approved and processed by the bank. After placing your order, your credit card shall automatically be debited with the full amount due. Once the payment is cleared, you will receive an automated confirmation email of your order. If the bank or credit card company does not approve the transaction, the order will be automatically cancelled and the client will be informed directly during the order process, seeing the order as not completed, being notified that the payment has been rejected.

8.5 For some banks, it is necessary to make an official request to access and use our online payment service. Under no circumstances will Deals.mu be liable for any kind of commission that your bank might charge you for fees or charges, associated with the payment paid to Deals.mu.

8.6 In the event that you dispute a charge and it is determined that the charge was valid and not the result of credit card or other payment fraud, Deals.mu has the right to seek payment, including all associated fees, by whatever means necessary, including using legal proceedings.

8.7 Customers using chargebacks will be reported to all major credit bureaus as a delinquent collection account. Furthermore, these customers may be blacklisted, having their Deals.mu account deleted, preventing them from using, registering and booking via Deals.mu.

8.8 For payments made in cash at the Deals.mu Head Office. Should any issue or mistake in payment occur, then, it is your responsibility to inform Deals.mu immediately so that the issue can be managed and resolved as soon as possible. If the issue is not brought to the attention of Deals.mu within 2 hours from the time of cash payment, then Deals.mu will not be able to assist and cannot be held responsible for any losses you may incur.

9.0 Pricing and Programming Errors

9.1 Deals.mu does not guarantee against pricing errors or programming issues and reserves the right to not process orders or to cancel orders for an offer which has an incorrect price or where the price has been incorrectly displayed or problems with programming occurred and resulted in an error. If this happens, Deals.mu will notify you by email and or by phone, the order will be cancelled and a full refund will be given. In addition, we reserve the right, at its sole discretion, to correct any error in hotel and other activities availability.

10.0 Cancellation by Deals.mu

10.1 In the unlikely event that the package you have booked has been cancelled by the service provider, then your booking is 100% refundable. Please note that the service provider may offer you an alternative date and/or time.If you choose to accept a new date/time for the package, then an amended booking confirmation will be sent to you reflecting this change and you will not be entitled to any refund or compensation from Deals.mu. If for any reason the service provider fails to offer the package or an alternative date and/or time, then you may choose any other package on Deals.mu for the equivalent value. Otherwise, you may choose to have a full refund.

10.2 If an offer or package has been postponed or cancelled due to bad weather, then no compensation for travelling/fuel etc. will be issued by Deals.mu except for the full refund amount, paid directly for the activity (see 12.0 Force Majeure).

10.3 Clauses 10.1 and 10.2 are only applicable if Deals.mu has cancelled the package and there have been no amendments by the customer to the original booking. If the customer had changed their original booking ie. a different date or time, Deals.mu may charge a cancellation fee according to the original date or time of the booking made or a 5% handling fee (See 11.3).

11.0 Cancellation or Changes to a Booking by the Customer

11.1 If, for any reason, you decide to cancel your confirmed booking, Deals.mu will refund you the appropriate amount as per the cancellation policy applicable. Accordingly, do note that in some cases when cancelling your confirmed booking, you would be charged a cancellation fee (see 11.6).

11.2 Deals.mu charges different cancellation fees according to the order option chosen by you and its status (if the product has been already reserved for a specific date or not). Some service providers may also have their own conditions and policies, including non-refundable or cancellation fees, so be sure to check the policy before making your reservation. It is the customers responsibility to check and/or request the cancellation policy for each package before making their reservation.

11.3 Any alteration, amendment or changes by the customer to an existing confirmed booking, ie. a change in date, will incur a 5% handling fee. The handling fee is waived and the Deals.mu cancellation policy will apply should you choose to cancel your booking or if the service provider cannot accommodate the change.

11.4 For the avoidance of doubt, the term ‘product’ as used in these terms and conditions refers to vouchers purchased directly from the Deals.mu and include monetary vouchers, activity vouchers, spa treatment vouchers and hotel day package vouchers.

11.5 Cancellation of a product booked as Open Voucher. Please note that in case a customer would like to cancel an Open Voucher before the product was reserved for a specific date, then the customer will only be charged with a cancellation fee of 15% of the total booking amount.

11.6 Cancellation of a product reserved for a specific date. This option refers to cases in which a product has been booked and reserved by the customer for a specific date (the specific date or time for which the customer is supposed to go on the activity/attractions/service/day package/spa according to the reservation), including i) Cancellation of a product which has been reserved for a specific date as part of the initial order process ; ii) Cancellation of an open voucher / gift voucher after it was used by the customer to reserve a product for a specific date. In both these cases, cancellation charges apply according to the table here below:

Please Note: All the above refers to working days only (Monday - Friday, excluding weekends and public holidays)

11.7 Notice of cancellation will only be effective when it is received by Email sent to Deals.mu on info@deals.mu, on working days Monday to Friday between 08h00 - 17h00 (weekends and public holidays are not considered). The date of which we receive the customer’s written notification of cancellation is the date we will use in order to calculate the appropriate cancellation charge.

11.8 These cancellation charges are calculated as a percentage of the Subtotal order amount for the product the customer would like to cancel. Where the cancellation charge is shown as a percentage, this is calculated on the basis of the total amount payable by the customer for the cancelled product.

11.9 No refund is available once a booking, tour, spa, day package, activity, attractions, package or service has commenced, or in respect of any package, spa treatment, meal or any other services has already been utilized.

11.10 In case a product is cancelled due to bad weather conditions prior to the start of the activity, we guarantee to all of our customers a Full Refund. However, if the product is operational, rain or shine, and the customers decide not to go or attend the booking, then the customer will be charged for the last minute cancellation.

11.11 In case of a “No Show” or in case a customer is arriving late to an activity, the tour will leave on time and the client will be charged for a last minute cancellation fee (100% cancellation charge).

11.12 If any member of your party is prevented from travelling, that person may transfer their place to someone else. In case the order/booking was made under the name of the person who is prevented from travelling, you must inform Deals.mu as soon as possible about this change and provide the name of the other person who will use the product.

11.13 Gift Vouchers, entrance tickets to Museums, national parks, Mauritius Aquarium, Botanical garden, Curious corner and tickets for special events, are non-refundable in all circumstances. Meal Vouchers are non-refundable and non-exchangeable.

12.0 Refunds

12.1 Refunds are only processed via Deals.mu’s head office. Should you request a refund, then you need to contact the Deals.mu Head Office directly by email. Refund requests submitted via any other method will not be considered.

12.2 Refund of processing fees. In case of any cancellation for which a refund is to be provided to the customer, Deals.mu is not liable to refund the credit card processing fees nor any other bank fees associated with the purchase made by the customer. The customer will only receive the applicable refund calculated as per the Deals.mu refund policy, after deducting the fees detailed hereof.

12.3 All refunds will only be made using the original form of payment. For example, if you completed payment using a Visa card, any refund will be credited back to that same Visa card. It normally takes 10 - 15 working days for the refund to be processed from our side.

12.4 A change in personal circumstances or a change of mind does not entitle the customer to a refund.

12.5 Refunds applicable for Non-eligible customers. Deals.mu is a platform created and dedicated exclusively for Mauritians and local residents of Mauritius. As such all the deals, offers and packages are valid and applicable only for Mauritians bearing a local ID card or for local residents, having a Mauritian resident permit. These are the basic requirements for booking any of the services offered on Deals.mu. it is in the responsibility of the customer to comply with these basic requirements. In case of any purchase made on the Deals.mu website by a tourist, foreign customer or any customer who is neither a Mauritian citizen nor a local resident, Deals.mu will regard this customer as a non-eligible customer and may choose to reject the customer booking. In this case, Deals.mu will charge the customer for a cancellation fee set at 15% of the total purchase amount made by the customer.

13.0 Force Majeure

13.1 Deals.mu will not be liable under these Terms due to its inability to perform its obligations by reason of, but not limited to any act of God, fire, earthquake, blizzard, flood, bad weather or forecasts, epidemic, accident, explosion, casualty, strike, lockout, labor controversy, riot, civil disturbance, act of terror, embargo, war, any law ordinance or regulation, legal order (unless caused by Deals.mu’s default hereunder), any failure or delay of any transportation, power, or communications system, technical or maintenance issues or any other similar cause not under Deals.mu’s control. No refunds will be issued in such unforeseeable circumstances.

13.2 Deals.mu also reserves the right to cancel scheduled tours, operations, attractions and activities at any time in the event of hazardous weather conditions or unforeseen operational problems. We reserve the right to refuse admission to anyone at its sole discretion.

14.0 Customer Behavior Policy

14.1 As a customer of Deals.mu, you are responsible for your actions and behaviour as well as the group actions and behaviour of your party by which you are expected to respect your environment and other people around you. You must not behave in a way that can cause distress or embarrassment to others or that can create a risk of danger or damage to property. The Service Providers or any staff associated with the package have the right to evict you or discontinue the product/service under the threat of acts of vandalism, violence or any other behavior considered inappropriate by them. In all these cases mentioned herein, all insurance will be invalidated and you will not be entitled to reimbursement, remuneration or to cover all your expenses of any kind.

14.2 You shall be held liable for all reasonable costs, expenses and losses associated with any loss including, but not limited to, all direct, indirect, vicarious, consequential, exemplary, incidental, special or punitive damages, including lost profits.

14.3 For some activities, such as rafting, diving, quad biking, sky diving and others, Deals.mu or the Service Provider will request you to fill in and sign a waiver. Should the customer deny to sign the waiver form, the supplier could take the decision to exclude the client from that specific activity and no compensation or refund will be given.

15.0 Complaints and Problems

15.1 A complaint is only valid if it has been filed to the Service Provider on the day the package is redeemed, before the end of the package duration.

15.2 In the unlikely event that are still dissatisfied with the Service Providers solution or you have any complaints or experience problems with Deals.mu’s service or a package offered by Deals.mu, this should be brought to Deals.mu's attention immediately and no later than 24 hours from the day the package was redeemed. You can contact Deals.mu by calling 269 1500 within office hours or by sending an email to info@deals.mu.

15.3 Complaints filed to Deals.mu should include your booking reference and full details of your complaint. The assistance we provide to resolve your complaint is provided on behalf of our suppliers in our capacity as agents only. We will do our best in order to claim a full refund or compensation from our supplier on your behalf.

15.4 Please note that if you do not follow this simple complaints procedure, Deals.mu will not be able to claim reimbursement or compensation on your behalf, and therefore you will not be entitled to a refund or lose any compensation.

16.0 Intellectual Property And Right To Use

16.1 Copyright. The Site contains copyrighted material, trademarks and other proprietary information, including, but not limited to text, software, graphics, designs, compilation, video, music and sound. The entire contents of the Site are protected under applicable copyrights, trademarks, registered trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication of any such matters or any part of the Site by you for commercial gain is strictly prohibited unless authorized in written by the owner of the site. You do not acquire ownership rights to any content, document or other materials viewed through the Site. You will be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights or any other harm resulting from such a submission. Nothing on this site should be copied or used for commercial gain without the written consent of the owner.

16.2 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content contained within the Website shall remain at all times owned by us or our licensors. You are permitted to use this material only as expressly authorised by us.

16.3 You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only except with written authorization from Deals.mu. Viewing, printing or downloading any content, graphic or media from Deals.mu, grants you only a limited license for use. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, broadcast, sell, license, display, distribute, commercially exploit or create derivative works of such material and content.

17.0 Original Language and Translations

17.1 English-Language Version Controls. In the event there is a discrepancy or inconsistency between the English language version and another version of these Terms in a different language, the English version will prevail, govern and control.

By using Deals.mu, you agree to indemnify Deals.mu and its employees against any liability, although we may at our discretion agree to assist in the resolution of problems, and take our own action against any supplier and third party who is in breach of its obligations.

21.2 Deals.mu cannot be held responsible if personal belongings are damaged or stolen during an event. It therefore follows that Deals.mu is not obliged to compensate you for damages in this regard. You have a personal responsibility to take care of your personal belongings and valuables. We will accept no responsibility for loss or damage to personal property or valuables.

21.3 Neither Deals.mu, Directors, Employees, service providers, partners, or any other indemnified party are or will be responsible or liable to you or to any third party for any indirect, incidental, consequential, special, exemplary, punitive or other damages (including, without limitation, damages for loss of business or lost profits). Under any contract, negligence, strict liability or other theory arising out of or relating in any way to the site, the materials on the site or any product or service obtained through the Deals.mu. Thank you for visiting the Terms that govern the Deals.mu Loyalty Program which is brought to you by ABZ Global Solutions Ltd (“Deals.mu,”:ABZ Global Solutions Ltd” “we,” , “our’, or “us”). You agree to these Terms by participating in the Program. The Program is a customer-loyalty program through which Deals.mu offers eligible individuals the opportunity to earn points and qualify for different tiers of benefits and awards as explained throughout these Terms. Please see our Privacy Policy and General Terms and Conditions, all detailed and available on the Deals.mu website, which are also applicable to your participation in the Program.

1.0 Membership

1.1 New Member Enrollment. To participate in the Program, eligible individuals must be at least 18 years old and must have an account on Deals.mu. New members, when creating an account need to provide the required information and follow the instructions to enroll. Account holders of Deals.mu will automatically be transferred into the Program.

1.2 Ranks Upon Enrollment. Upon enrollment in the Program, Members automatically have a Bronze membership rank, which allows Members to earn points. Once the prescribed number of points have been accumulated, members can increase their rank and will be able to redeem their points and receive additional benefits. 1.3 One Membership/Account Per Person; No Sharing of an Account. There is a limit of one membership/account per person and per email address. Accounts cannot be shared or combined. A Member’s Account cannot be used by anyone other than the Member in order to accrue, redeem, use, or enjoy points, credit, awards, or other benefits.

1.4 Program Site Account Access & Security. Upon enrollment in the Program, you will be assigned an Account and asked to provide a password that will allow you to access account information and redeem rewards on the Program Site. If you have forgotten your password, you can request a new password through the “forgot password” feature either on the Program Site or by phone through customer service. Deals.mu is entitled to act on instructions received under your membership account. You are solely responsible for keeping your password, Account, and other account access information confidential and for restricting access to your computer and other devices, as applicable, so that others may not access your account, and Deals.mu will not be responsible for your failure to do so.

1.5 Verification; Maintaining Member Information. You are responsible for keeping your membership information current and notifying Deals.mu of any change to your membership information. Registration and account creation are subject to verification by Deals.mu in its sole discretion. Deals.mu also reserves the right to verify the information collected during Program registration or provided during participation in the Program and, in its sole discretion, suspend or terminate any account and prohibit Program participation by any individual or email address related to or suspected of being related to fraudulent activity, including, without limitation, signing up for multiple accounts.

2.0 Points and Rewards

2.1 Deals.mu Rewards. Any member of the Deals.mu loyalty program – Deals.mu Rewards can earn and redeem Rewards Points based on their actions on Deals.mu. A number of services and benefits are available to Deals.mu Rewards Members. These benefits and rewards are offered solely at the discretion of Deals.mu, and the rewards, benefits and/or participating events may change from time to time. Not all rewards and additional benefits are provided by all products or services on Deals.mu. Rewards and benefits are available only for direct bookings through Deals.mu’s website directly, on Deals.mu. All rewards are subject to limited availability, and to the terms and conditions and restrictions imposed by Deals.mu and Service Providers.

2.2 Earning Points. Members can only earn points through valid and authorised actions. All valid actions are mentioned in the Earn Points section and are worth an allocated amount of points. Points can also be earned through Special offers and promotional operations organised by the Program. In this context, earning Rewards Points depends on meeting specific conditions that apply to each offer or operation, and that are communicated to Members. Members will not earn Points and/or enjoy Member benefits for actions or bookings made through bookings made directly at the Deals.mu head office, or through any unauthorized agents or any other online portals excluding Deals.mu.

2.3 Rewards Points Scale. The Programme offers five Status/ Rank levels that are attributed according to the number of Reward Points earned during the period of the past 12 months by the member. Members may, at any time, access a higher Status/Rank if they reach the required number of Reward Points. The scale for earning Rewards Points for each Status is shown in the table below:

2.4 Reward Points. Only Members of the Program may earn and redeem Rewards Points from their account or as part of the order process. Members can redeem their Rewards Points to obtain Rewards, including: – Discounts, Upgrades, and other benefits. Rewards Points are valid for six (6) months from the last date of an “earn” or “redeem” points transaction.

2.5 Coupons. Each coupon is identified by a Coupon Code and has different requirements and rewards. Coupon values and rewards are as specified on the coupon. You can decide to claim the reward desired while being bound by the conditions linked to the redemption of the coupon. Coupons are redeemable online on Deals.mu and cannot be used elsewhere. To redeem the coupon, the coupon code must be entered into the relevant field on the Deals.mu website and the relevant reward will automatically apply. Each coupon is valid for a limited time only and expires on the date specified. If the coupon is not redeemed within the time specified, then no reward will apply or can be claimed. Coupons are not transferable and are not redeemable for cash and cannot be combined with any other coupons or any other offer or discounts or promotions offered by Deals.mu. Deals.mu reserves the right to discontinue a coupon at any time. If a product or service is cancelled and you are entitled to a refund for a product purchased with a coupon, the coupon discount or value will be subtracted from the return credit.

2.6 Redeeming Rewards. Coupons and Reward Points can be redeemed on the Deals.mu website to claim rewards. Reward points can be redeemed during the online order process to receive a cash discount. The amount of reward points you wish to redeem should be entered during the checkout process and the discount will automatically be applied to the total of your order. Coupons can be redeemed either as part of the order process to receive a discount or on the user’s account page to receive reward points. For coupons with a discount applicable on a purchase, the coupon code must be entered in the relevant field as part of the online order process. The coupon will be redeemed and the discount will automatically be applied to the total of your order. If you fail to enter the coupon code at the time of purchase as specified, the purchase will not be eligible for the discount. Discounts may not be claimed after confirmation of a purchase on Deals.mu. For coupons which award Reward Points, the coupon code must be entered in the relevant field on the user’s account. Once the coupon code has been applied, your total reward points will adjust accordingly.

2.7 Cancellation or Retracting rewards. Members who cancel and/or do not use their reward (no-show) will not receive any refunds or have their Reward points re-credited.

2.8 Non-transferable, Non-exchangeable, Non-refundable. Points, awards, membership benefits, and other aspects of a Member’s account in the Program do not constitute property of the Member. Except as expressly set forth in these Terms, points, awards, membership benefits, and accounts cannot be given away by a Member and are not negotiable, commissionable, or redeemable for cash, and are void if a Member sells, barters, auctions, donates, assigns, conveys, or otherwise transfers them (or makes any attempt to do so) in a manner not expressly allowed by these Terms. In the event that a Member makes any attempt to sell, barter, auction, donate, assign, convey, or otherwise transfer his or her points, awards, membership benefits or account to a third party in violation of these Terms, all persons involved in advertising, facilitating, or administrating the prohibited transfer may, in Deals.mu’s sole discretion, immediately forfeit all points or awards, have their respective membership terminated, and be barred from future participation in the Program or any other Deals.mu loyalty program.

Deals.mu may in some circumstances permit the transfer, combination, or conversion of points or awards or the merger of accounts in the Program. Deals.mu reserves the right, in its sole discretion, to reverse or refuse to process any transfer, combination, or conversion of points or awards or merger of accounts, including, without limitation, if Deals.mu suspects that any party to the transfer, combination, conversion, or merger has acted fraudulently, attempted to circumvent the qualification requirements for higher ranks in the Program, or otherwise violated these Terms.

3.0 Loss of Points; Termination of Your Membership; Termination of the Program

3.1 Inactivity. If a Member’s account is inactive for six (6) consecutive months, all points in that Member’s account will be forfeited at that time, but the Member’s account will remain open (with the ability to earn new points thereafter) unless the Member’s account is otherwise terminated in accordance with these Terms. Under no circumstances will forfeited points be reinstated. To maintain the Reward Points in your membership account, you must have at least one “earn” or “redeem” transaction posted to your account every six months (6) months. Your rank will be based on the total reward points accumulated over the past 12 months. If the total reward points accumulated over a 12-month period do not meet the reward point requirements for specific ranks, then your rank and benefits will adjust accordingly.

3.2 Causes of Membership Termination. Deals.mu may immediately, without notice, limit or terminate your membership if you: (i) violate these Terms or any other applicable additional terms or appear to be utilizing the Program in a manner inconsistent with these Terms or the intent of the Program.

3.3 Termination by Member. If you are a Member and would like to discontinue your membership, you may request that Deals.mu closes your account by contacting Deals.mu customer service. Once you submit a termination request, termination is irreversible and your account will be closed and all points, awards, and benefits forfeited as described below.

3.4 Effects of Termination. If your membership is terminated, you will lose all points, awards, and benefits associated with your account and you will no longer be able to earn or redeem points or awards in the Program. Likewise, your future participation in the Program may be prohibited at Deals.mu’s sole discretion.

3.5 Termination of the Program. We also reserve the right to terminate the program completely at any time by providing active members with written notice or no notice as required or permitted by applicable law. any points or awards in your account or otherwise held by you on the effective date of termination will be forfeited. Any conclusion to the program that results in the transfer of members to a successor loyalty program, where such members do not forfeit all unexpired, unredeemed points in their account as a result, will not be considered a termination of the program for the purposes of the above notice provision.

4.0 Modification of These Terms; Modification to the Program

4.1 Modification of These Terms. Deals.mu reserves the right to modify these Terms from time-to-time. The updated Terms will be effective as of the time of posting. Unless otherwise stated, the updated Terms will apply to your participation in the Program beginning as of their effective date.

4.2 Modification to the Program. Deals.mu reserves the right to, from time to time, among other things: change earning ability; withdraw, limit, modify, or cancel any award or benefit; cancel or change partner awards or programs; increase or alter the point or other requirements to earn an award or benefit; modify the membership tiers or the benefits available to any tier; add blackout dates; or limit the number of rewards available for any or all products/services. Deals.mu may limit the number of Program participants and may temporarily or permanently discontinue registering new Members at any time and for any reason without notice.

Your participation in the program is at your own risk.

Without limiting the foregoing, Deals.mu does not represent or warrant that the information related to the program is accurate, complete, reliable, useful, timely, or current or that the program will operate without interruption or error. Despite our commercially reasonable efforts, the program site and other program materials may contain typographical or other errors or inaccuracies, including, without limitation, regarding the amount or value of a particular award, the number of points required to redeem a particular award, the number of points to be awarded for a particular action, the ability to redeem an award or receive a membership benefit. Deals.mu will not be responsible for any such error, typo, or misprint in these terms or any program materials. Deals.mu reserves the right to void or refuse to process any program award, purported point-earning event, or other transactions arising out of such an error, typo, or misprint.

Deals.mu will not be liable for any acts, errors or omissions of any other member, a third party or program partner or any partner’s loyalty or rewards program.

7.1 Force Majeure. Deals.mu and/or the Deals.mu loyalty program- Deals.mu Rewards is not responsible or liable to you, or any person claiming through you, for failure to supply or fulfill an award, benefit or points in this Program in the event the Program or its operations are affected by any acts of god, any action, regulation, order or request by any governmental or quasi-governmental entity, equipment failure, actual or threatened terrorist acts, weather, natural phenomenon, war (declared or undeclared), fire, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, civil disturbance, insurrection, riot, or any laws, rules, regulations or orders or other action adopted or taken by any national, federal, state, provincial, or local government authority, or any other cause, whether or not specifically mentioned above.

7.2 Decisions of Deals.mu are Final. All decisions of Deals.mu related to the earning, transference, and use of points, awards, benefits, or other aspects of your membership account, to the Program, or to these Terms, including any decision to deduct points from an account or deny awards or benefits, are final and binding upon you and you agree to abide by all such decisions.

7.3 Taxes May Apply. Points, awards, and other membership benefits may be subject to taxes and all associated obligations are each Member’s sole responsibility.

7.4 Severability. If any part of these Terms is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms will govern such participation.

7.5 Law Enforcement/Governmental Requests. You agree that nothing contained in these Terms is in derogation of Deals.mu’s right to comply with law enforcement or governmental requests or requirements relating to your participation in the Program or information provided to or gathered by Deals.mu with respect to such participation.

7.6 English-Language Version Controls. In the event there is a discrepancy or inconsistency between the English language version and another version of these Terms in a different language, the English version will prevail, govern and control.

7.7 Precedence; Waiver; Interpretation. If and to the extent that there is any conflict among or between the Program Site or other Program marketing materials and these Terms, the language in these Terms will govern. Deals.mu’s failure to or decision not to enforce any provision in these Terms will not constitute a waiver of that or any other provision. The invalidity or unenforceability of any provision of these Terms will not affect the validity or enforceability of any other provision.

Visa Mauritius E-Commerce Campaign 1.0 Overview of the campaign

The campaign is valid for every Visa credit or prepaid cardholder, who spends a minimum amount of USD 125/Rs 5,000* with his/her Visa credit or prepaid card. Such spending must be within the first 3 online transactions (whether local or abroad) during the promotional period.

The MCB Visa credit or prepaid cardholder will be rewarded with a USD 12.5 / Rs 500 cashback credited to his/her MCB Visa credit or prepaid card. Every cashback reward will be taken from the budget allocated by Visa until the budget is exhausted.

2.0 Disclaimer

The campaign is operated by The Mauritius Commercial Bank Ltd (MCB), who is the issuer of the Visa cards, and is financed by Visa. Any issues you may have with respect to your Visa card should be directed to MCB, who is the card issuer and not to Visa. The Terms & Conditions of this campaign relate to Visa only. None of the Terms & Conditions or agreement between MCB and its cardholders have any effect on or are related to these Visa Terms & Conditions.

3.0 Duration

The campaign will run between 10th and 28th February 2021 but will end beforehand if the Visa budget is exhausted, whichever comes first.

4.0 The campaign is subject to the following Terms & Conditions

4.1 The customers who are eligible to participate in the campaign are prepaid cardholders or primary and secondary holders of Visa credit cards issued by MCB (excluding Visa Business/Corporate cards, Visa prepaid 13-17, Visa College). Their participation rights and consent are tied to their Visa cardholder status.

4.2 MCB employees, customers under 18 and those undergoing recovery procedures with the Bank are not eligible to participate in the campaign

4.3 “Qualifying Transactions” are the first 3 online transactions (whether local or abroad) with a cumulated spending value of USD 125 / Rs 5,000* and above, made by every Visa cardholder, within the campaign duration, or until the cashback budget is exhausted. Gaming and gambling transactions are excluded.

4.4 The cashback reward per eligible Visa cardholder is USD 12.5 / Rs 500*.

4.5 The cashback reward will be credited to the cardholder’s Visa card from a Visa agent. In the case of secondary credit cardholders eligible to cashback, the latter will receive their reward on the primary card account. The cardholder is not expected to take any action in this regard.

4.6 Visa takes no responsibility for any inaccurate reporting or non-visibility of “Qualifying Transactions” either by collections of files only or non-accessibility.

4.7 The campaign will run between 10th February and 28th February 2021. Each Friday, the Bank will review the week’s transactions based on authorisation date and time to determine customers who shopped online (whether local or abroad) with their Visa card and who are eligible for the cashback reward. These customers will receive an SMS notification from the Bank, informing them that the cashback will be credited to their Visa credit or prepaid card within 2 weeks after end of campaign.

4.8 A customer can win only once.

4.9 The winner, by accepting the cashback, confers the right to the MCB to publish his name and photo in the media, in communication and advertising supports, as well as at points of sale. The winner may be called upon to appear in the national media for free.

4.10 The campaign excludes gambling and gaming transactions.

5.0 Warranty

MCB warrants and undertakes to Visa that prior to publishing the winners names and images it shall have procured the necessary consents from the winners to publish the names and images of such winners.

Coronavirus (COVID-19) Policy

In response to the COVID-19 pandemic, Deals.mu is devoted to bringing you as much flexibility as possible while adhering to all recommendations from local authorities and public health experts.

In the event the Government introduces stricter restrictions, suspensions, quarantines or lockdown measures the following policies will be in effect:

i) Specific Booking dates that fall in lockdown period - Should your booking dates fall in the lockdown period, your booking will automatically be cancelled and the amount paid will be converted into a Deals.mu credit on your Deals.mu account. This can be used once the restrictions have been lifted, and is valid for 1 year.

If your booking does not fall between any lockdown dates, then the booking will still be valid [see iii) Bookings that do not fall in lockdown period].

ii) Vouchers in lockdown period - For Spa Vouchers, Activity Vouchers, etc. where the voucher has not been used but the validity ends in lockdown period, the validity of the voucher will automatically be extended for 120 days after lockdown. If the service provider cannot accommodate for the booking, the amount paid will be converted into a Deals.mu credit on your Deals.mu account. This credit can be used once the restrictions have been lifted.

iii) Bookings that do not fall in lockdown period - Booking dates that do not fall in the lockdown period will proceed as usual. If you wish to cancel a booking that does not fall during the lockdown period, please note that the standard cancellation policies will apply. If service providers agree to process your cancellation request, the amount paid will be converted into a Deals.mu credit on your Deals.mu account.

Deals.mu Credit Note: Credit Refunds which were given during the lockdown period (due to bookings which could not be carried out) are valid for 1 year. The credit will be made available for your use once the restrictions have been lifted and can only be used on the Deals.mu platform.
